"No person in the US shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance."

What is Sexual Harassment?

Sexual harassment is conduct that:

  • is unwelcome;

  • is determined by a reasonable person to be severe, pervasive, and objectively offensive that it effectively denies a person's equal access to the school's education program or activity.

  • Quid pro quo – a District employee conditioning the provision of an aid, benefit, or service of the district on an individual’s participation in unwelcome sexual conduct.

  • Unwelcome conduct to be determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the District’s educational program; or

  • "Sexual assault” (as defined by the Clery Act), “dating violence”, “domestic violence”, or “stalking” (as defined in the Violence Against Women Act)

Incidents of sex discrimination in a school's activities and programs may be reported directly to the Title IX coordinator (see link below). Reports can also be made to building principals.

The Title IX coordinator has the duty to address each report and remedy the effects on the victim and the school community. Every effort will be made to maintain confidentiality, but the Title IX team may be required to investigate the incident.

Law Enforcement

LAW ENFORCEMENT

FCSD1 encourages reporting possible crimes to law enforcement. Please be advised that criminal processes are independent of FCSD1. Even when a report has been made to law enforcement, employees are required to make a report to the Title IX Coordinator; all others are encouraged to report to the district as well.
